Codicil

Codicils, which are additions or modifications to a will, are becoming less and less common with the improvement of word processing technology and the ease of which a new will can be drafted. The Internet provides access to many templates that make drafting a new will easier than worrying that codicils are overturned by the probate court. Using codicils to amend wills means making sure all dates and pertinent parties are specifically defined and that the codicils are kept updated. In the case of remarriage this can get very confusing and so writing a new will often much simpler. Codicils are betters suited for making small changes that can't be misinterpreted. Other changes should be made with a completely re-written will that is properly witnessed and signed.

Fast Facts

  • A beneficiary of a codicil cannot be a witness to the codicil or it is considered invalid.
  • A will cannot have changes made by simply crossing out the unwanted parts, either it must be redrafted or codicils must be added.
