Joint Tenants With Right Of Survivorship

Joint tenancy with rights of survivorship is typically a deed that shows two people own equal interests in a property, usually real estate. These two people are usually husband and wife but do not have to be in order to have a joint tenancy with rights of survivorship. Once one of the parties passes away the other party produces a death certificate and records the death in order to have a clear title to the property. This type of ownership allows homeowners or property owners to avoid probate and the costs involved with having deeds changed, it also allows for the ownership of the property to remain private. This can be helpful in preventing others from objecting to the surviving owner having the property, in a joint tenancy no one needs to know who owned the property or how it was transferred.

  • Although creditors cannot reach the deceased owner's portion of the property after their death, during their life, creditors can reach either tenant's share if necessary.
