Succession is the distribution of property under the state's intestate succession laws and also applies to the how property or legal rights are passed after death. If the estate is intestate, succession is determined by state law which is typically based on relationship such as spouse and children. Succession based on testate is determined by the testator's will. In this case, the passing of property from the testator to the beneficiaries is specifically listed in the will. Succession can apply to property or positions in businesses.
