A probate court record is a record that contains all probate information that was involved in a probate court case. It will include all of the facts and details of the case. A probate court is a court with the power to settle estates and probate Wills. In some states, it is referred to as surrogate court. A probate court could also appoint guardians for children under 18 of an estate in some states.

Things That Can Be Presented at Probate Court:

  • Property Being Left Behind From Someone Who Passed Away to Someone Else
  • Mental Health Hearings
  • Guardianships
  • Name Changes
  • Adoptions
  • Marriage Licenses
  • Living Trusts/Living Wills

Probate Court is also considered to be a type of "Trial Court" where there could be probate litigation. A huge part of all Probate Court cases are either involving marriage, estates, and guardianships. The rest of the cases, which include adoptions and mental heath hearings, make up a very small percentage of all Probate cases.
